What is Defamation?

When a competitor, media organization, or another individual make negative statements about you in the press or online, it may be considered defamation. There are two primary categories of defamation: slander and libel. Slander occurs when an individual speaks negatively about you in an effort to cause harm, which will typically take place in a video interview, on the radio, or in some other way where they are physically speaking. Libel, on the other hand, occurs when another party writes negative things about you online, in the press, or in any other written capacity.

Proving Defamation

In order to have a successful defamation case, you must be able to prove that the other party published or broadcasted the statement in question without authorization, that the statement is false, that you were harmed as a result of the statement, and that the other party failed to verify these claims. When proving you were harmed, you may be able to show that your business took losses, you lost wages, and that you suffered emotional distress as a result of the statements. Be aware that you must file a defamation claim within one year of the incident in accordance with New York state law.
