Bryan J. Swerling was recently featured on silive.com. In this article, Mr. Swerling’s client was injured in a high school cafeteria brawl which led to a head injury. The victim’s mother sued the city and Department of Education because of an alleged failed “proper and adequate” supervision that led to a dangerous situation to develop.

The complaint states that the defendants failed to uphold their duty to protect students from behavior that would likely endanger the safety of other students.

The suit maintains that the girl was free of contributory negligence.

This is the second suit in 2017 regarding a New York City school cafeteria brawl.
