When someone gets injured on another person’s property in New York City, they may wonder what their legal options are. Many accidents result in serious injuries as well as the high medical bills, lost wages, and other financial expenses that come with them. When an injured party wishes to bring a personal injury lawsuit against the party whose negligence caused them to become injured, they will need to fulfill the burden of proof. Fulfilling the burden of proof is really just a matter of compiling evidence that shows the property owner failed to maintain a safe property and that their negligence resulted in the accident.

There are many ways in which an individual can fulfill the burden of proof. The best way is to always have photographic evidence. If it is at all possible, the injured party or someone they are with should be sure to take pictures or videos of the scene of the accident and the dangerous conditions that are present before leaving that location. Of course, this may not always be possible. In some cases, it may be possible for the injured party to obtain surveillance footage of the accident taking place. If there are any witnesses present, it may be beneficial to get their contact information so they can make a statement later on. Additionally, it is important in some situations to contact the police, especially for motor vehicle accidents. In these situations, the police and emergency services will both conduct reports, document your injuries, and determine who is at fault. Of course, this can be critical if you are trying to prove your case.
